New York Attorney General Takes Over Cornell Investigation After Local DA Removal

New York Attorney General Letitia James has taken over the criminal investigation into a gang-rape allegation at Cornell University after Governor Kathy Hochul removed the local district attorney on October 1, 2026. Law Commentary reported that Hochul cited a complete loss of confidence in Tompkins County DA Matthew Van Houten's handling of the case, which was originally closed without charges in 2024 despite the accuser explicitly telling police she was raped.
The takeover came after civil court documents revealed that campus police withheld crucial testimony from prosecutors, and the DA never interviewed the accuser or key witnesses before dropping the case. Yahoo News reported that President Trump responded angrily to James's appointment as special prosecutor, though Hochul and James pledged a full criminal review.
The original investigation collapsed after Cornell University Police Department withheld the accuser's complete statement from prosecutors. Law Commentary reported that campus police submitted incomplete transcripts to DA Van Houten's office, omitting her explicit statement: 'I can say with 100% confidence I was raped.' The DA later admitted to local media he never read the full transcript before closing the case in 2024.
Van Houten claimed the accuser never explicitly said she was raped—a defense that fell apart when the civil lawsuit exposed sworn police interview transcripts proving otherwise. Yahoo News noted that the DA reopened the investigation on September 28, 2026, just days after the civil suit exposed these failures.
On October 2, Governor Hochul held a public briefing condemning what she called institutional failures across law enforcement and campus police. According to Law Commentary, Hochul stated: 'In what world does the district attorney not even interview her, or anyone else involved... at every turn, she was failed by people and institutions with an obligation to protect her.' She signed an Executive Order removing Van Houten from the case entirely.
AG Letitia James pledged to conduct a comprehensive criminal investigation, stating: 'We will review the facts, gather evidence, interview witnesses and, if warranted, pursue prosecutions.' Newsday reported that state lawmakers are now pushing for changes to New York's sexual assault laws to better protect intoxicated victims, using this case as a catalyst for reform.
The accuser filed a civil suit in September 2026 naming seven Chi Phi fraternity members as defendants: Matthew Ingalls, Johnathan Newell, Winston Lee, Gillio Lopes, Diego Sarabia, Scott Norris, and Scott Kretzschmar. The alleged assault occurred on October 19, 2024, when she was reportedly drugged with ketamine and cannabis. The civil case proceeds in parallel to the criminal investigation now led by AG James.
Two years passed between the initial assault report in November 2024 and the appointment of a state special prosecutor in October 2026. Law Commentary noted that the case has drawn national attention as part of broader scrutiny of how universities handle sexual violence allegations.
