The high court is making immigration a central theme of its new term and is already considering a significant election appeal over state policies to combat noncitizen voting. After returning to power in 2025, Trump reinterpreted an immigration law to find that people in the country illegal should be subject to mandatory detention. This shift has led to a significant increase in detention, with over 65,000 migrants held in detention compared to under 38,000 at the end of the Biden administration.
