US citizen shot by immigration agent in Chicago files federal lawsuit alleging coverup

Marimar Martinez, an American citizen who was shot by a Customs and Border Protection agent in 2025, has filed a lawsuit against the federal government alleging that the agent, Charles Exum, lied about the shooting and fired into her vehicle from behind. The lawsuit was filed under the Federal Tort Claims Act and does not allow for lawsuits against individual agents. Martinez was initially accused of using her vehicle to strike and box in Exum's SUV during "Operation Midway Blitz". Exum then allegedly opened fire, leaving Martinez with seven gunshot wounds. In the month after the shooting, prosecutors filed to dismiss the charges. Martinez's lawyers claim that an expert's analysis of her injuries indicates Exum was not in the path of her car when he opened fire. Exum is not a defendant in the lawsuit.
