Arizona court dismisses manslaughter sentence after artificial intelligence video used in court

The Arizona Court of Appeals has dismissed a 10-year manslaughter sentence for Gabriel Paul Horcasitas in the 2021 shooting death of Christopher Pelkey, citing a video generated by artificial intelligence that portrayed the deceased victim addressing a judge before the punishment was imposed. The court ruled that the video was unreliable and that it didn't accurately depict actual events and presented statements made in it as coming directly from the victim's sister. The use of AI in court is believed to be a first in U.S. courts and could result in another appeal. The victim's family used AI to create a video of Pelkey's likeness to give him a voice and played a victim's emotional impact statement during a May 2025 sentencing hearing. Prosecutors had argued that the AI evidence violated due process protections by relying on AI evidence.
