FSSAI Files Three Cases Over Nestlé Infant Formula

FSSAI said it examined both the infant formulas and their promotional material listed on e-commerce platforms before initiating action.
The regulator cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, in addition to the 2020 infant-nutrition regulations; the provision bars advertising and promotion of covered infant foods.
FSSAI announced the action on Instagram, saying: “Legal action initiated against Nestle India Ltd over several non-compliances pertaining to the FSS Act. FSSAI remains committed to strengthening the food safety ecosystem through its enforcement actions.”
Nestlé India shares fell to a reported low of Rs 1,332.80 after the adjudication notices were disclosed, according to NDTV Profit.
India's food safety regulator has filed three legal cases against Nestlé India over alleged violations in infant formula products. FSSAI said promotional claims for NAN Excella Pro Stage 1, Lactogen Pro 1, and a follow-up formula broke rules restricting advertising for baby foods. The regulator also found one formula failed to meet biotin requirements in lab testing. NDTV Profit reported that Nestlé India shares fell roughly 2% to 2.5% after the announcement.
FSSAI examined both the infant formulas and their promotional material on e-commerce platforms before taking action. The regulator cited claims including "5 HMOs," "Whey Protein," and statements that whey protein was easy to digest. just-food.com reported these claims violated Section 3 of India's 1992 Infant Milk Substitutes Act, which bars advertising and promotion of infant foods. FSSAI said in a statement: "Legal action initiated against Nestle India Ltd over several non-compliances pertaining to the FSS Act."
Laboratory testing and a referral re-analysis of one follow-up formula showed it did not meet prescribed biotin requirements, according to english.varthabharati.in. Biotin is a B vitamin essential for infant growth and development. FSSAI said it sought clarifications from Nestlé before initiating the adjudication cases. The action represents alleged violations and does not establish that a final penalty has been imposed.
Nestlé India shares dropped sharply after FSSAI disclosed the adjudication notices. adgully.com reported the stock fell over 2% in value, while NDTV Profit noted shares slipped to a low of Rs 1,332.80. The three cases mark the latest enforcement action by India's food regulator against the company's infant nutrition products. Nestlé India has previously stated its products are fully compliant with food safety standards.
